1. Definitions

“Reservation” shall mean a booking by the Guest for a visit to a resort.
“Guest” shall mean a person who has made a booking at any resort on the website.
“Policy” means this privacy and secrecy policy.
“Resort/s” refers to all the resorts with accommodation that can be booked on the site.
“NightSkyBookings” is a bookings website established in 2023.
“Web Site” shall mean NightSkyBookings web site, being www.nightskybookings.com
“PayStack” means the payment gateway used on this website to process payment transactions for guests paying for bookings.
“Third Party Supplier” means any resort signed up on the NightSkyBookings website.

2. Rules and regulations

By using and/or visiting the Website you agree to these Terms and Conditions and the Privacy Policy (the “Terms”), and you expressly consent and agree to be bound by the terms and conditions and all applicable laws and regulations that govern the Website and you are booking. If you disagree with any part of these terms and conditions, you must not use the Website.
NightSkyBookings is a self-service website that allows the public to book accommodation at various third-party suppliers.
Unless otherwise stated, we or our licensors own the intellectual property rights on the Website and material and content on the Website (including, but not limited to, text, images, web pages, logos, sounds, layouts, software (including code, interface, and website structure), materials, icons, video, look and feel, design and compilation thereof). Subject to the licence below, all these intellectual property rights are reserved, and you may not use intellectual property identifying or belonging to NightSkyBookings.com contained on the Website or otherwise without the prior written approval of NightSkyBookings.com.
When capturing a booking on behalf of another person, you must be authorised to make the booking on that person's profile. By making the booking, you are confirming that all persons named on the booking accept the Terms & Conditions, and you will inform the other persons named on the booking of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due under the booking.
NightSkyBookings.com will confirm your booking and issue you with an email confirmation. If you do not receive a confirmation email within 24 hours of your booking, please contact info@nightskybookings.com.
NightSkyBookings acts as a booking agent only in respect of all bookings we make on your behalf. By proceeding to book accommodation and/or other services through the Website, you accept that you will be entering into a contract with the resort on their standard terms and conditions.
Guests must be aware that we may not have conducted any quality or other checks on the resorts, and we make no representations about the suitability of the accommodation and/or services offered for sale through the Website.
To make a booking through NightSkyBookings.com you will need to create yourself a profile. Please make sure all information is correct and up to date. You will remain responsible for your online profile, so please do not allow anyone else to use it, and please keep your username and password secret.
All rates published on this website are subject to change without prior notice. Rates displayed anywhere on this website, other than a quotation, are to serve as guidelines only. Quotations are always subject to the availability of the Supplier.
Each third-party supplier will have their own Terms and Conditions that apply to your booking. It is your responsibility to familiarise yourself with the Terms and Conditions of the Supplier before completing a reservation.
NightSkyBookings takes measures to ensure that payment with a credit card on the NightSkyBookings website is secure. The primary actions taken to ensure this security are as follows:
- Credit card transactions will be acquired for NightSkyBookings via Paystack (www.paystack.com).
- NightSkyBookings does not store any complete credit card details on our system. PayStack secures all credit card details and then authorises the transaction.
- NightSkyBookings and Paystack use strict encryption. No credit card details are ever sent via unsecured methods.
NightSkyBookings.com will deduct the full balance of the booking from your card.
NightSkyBookings reserves the right to restrict, suspend or terminate your access to this website at any time if NightSkyBookings is of the view that you have breached these conditions of use.
For any modifications or cancellations of bookings, guests must contact the resort they booked with directly.
Any modification or cancellation fees must be discussed directly with the resort a booking was captured with.
All refunds owed to a guest by any of the third-party suppliers must be discussed with the specific supplier directly.

3. Privacy and security

For concluding a booking on the Web Site, NightSkyBookings shall request some personal information from the Guest. This information may include, but is not limited to:
- Full name and surname
- Email address
- Business or home address
- Contact telephone numbers
- Date of birth
- Your passport or ID number
- Your voluntary reviews of resorts
All personal information requested by NightSkyBookings is necessary for the lawful purpose for which the personal information is required, and no additional information will be requested by NightSkyBookings.
All personal information requested shall not in any way be used by NightSkyBookings for any other purpose other than for the purpose of effecting the booking unless such other use is required by law.
Personal information collected by NightSkyBookings is stored in a secure environment and is not available to any third party. NightSkyBookings shall not disclose any of the personal information held by it to any third party unless required to do so by law, or to the extent necessary for purposes of concluding the booking.
All information which has become obsolete, in the sole and absolute discretion of NightSkyBookings, shall be deleted by NightSkyBookings from its records and/or destroyed.
NightSkyBookings shall not sell, rent, or trade any personal information to third parties for any purpose whatsoever.
To ensure that your information remains secure, NightSkyBookings uses the Secure Sockets Layer (SSL) protocol, which encrypts any personal information you enter into forms on the Application. The encryption process protects your information by scrambling it before it is submitted.
In the unlikely event that the security of your personal information in our possession becomes compromised, we shall notify you thereof as soon as reasonably possible under the circumstances.
Guests will be able to unsubscribe from any email, cell phone messaging or WhatsApp communication by selecting the unsubscribe link within their profile.
NightSkyBookings owns and retains all rights to the non-personal statistical information collected and compiled by NightSkyBookings.
