TERMS & CONDITIONS

1. Introduction 

These Terms & Conditions govern all guided hiking experiences, outdoor activities, photography experiences, exploratory outings, slackpacking experiences, and related services provided by Peak Perspectives (Pty) Ltd (“Peak Perspectives”, “the Company”, “we”, “our”, or “us”). By making a booking, participating in an activity, or submitting a booking form, participants acknowledge that they have read, understood, and agreed to these Terms & Conditions. Peak Perspectives operates within Cape Town and the Western Cape, South Africa.

2. Bookings & Payment 

2.1 Booking Confirmation Bookings are only considered confirmed once payment has been received and acknowledged by Peak Perspectives. Quoted dates and availability may be held for up to 24 hours unless otherwise agreed in writing. Peak Perspectives reserves the right to release unconfirmed bookings after the holding period. 

2.2 Payment Methods Accepted payment methods include: EFT (Electronic Funds Transfer) Card payment Yoco payment link.

2.3 Deposits For larger, custom, multi-day, accommodation-linked, or advance bookings, Peak Perspectives may require a non-refundable deposit to secure the reservation. Unless otherwise stated in writing: A 50% deposit may be required to confirm qualifying bookings. Remaining balances may be due prior to the activity commencement date.

3. Cancellations, Refunds & Rescheduling 

3.1 Participant Cancellations made 7 days or more prior to the scheduled activity may qualify for a refund. Cancellations made less than 24 hours prior to the scheduled activity are non-refundable. No-shows are non-refundable. 

3.2 Rescheduling Participants may request to reschedule at least 24 hours prior to the scheduled activity. Rescheduling requests remain subject to availability and are not guaranteed. 

3.3 Refund Processing Approved refunds are generally processed within 3–5 business days. Processing times may vary depending on banking institutions and payment providers.

4. Late Arrivals 

The experience duration begins at the agreed meeting time, not participant arrival time. For private experiences, Peak Perspectives may wait up to 15 minutes at its discretion. Group activities operate according to schedule and may depart without late participants. Late arrivals may result in: shortened experiences, rerouting, rescheduling fees, or additional charges where extended guiding time is requested and available.

5. Weather, Safety & Route Changes 

Mountain and outdoor environments are inherently unpredictable. Peak Perspectives reserves the right to reroute, shorten, delay, reschedule, cancel, or modify any activity at any time due to: weather conditions, high winds, fire risk, trail closures, environmental hazards, participant capability, safety concerns, or guide discretion. Where conditions are deemed unsafe, Peak Perspectives will attempt to accommodate a rescheduled date or suitable reroute subject to availability. Where no reasonable alternative is available, a refund may be issued at the Company’s discretion. Guide safety decisions are final.

6. Participant Responsibilities 

Participants are responsible for: arriving prepared and on time, wearing suitable footwear and weather-appropriate clothing, carrying sufficient water, snacks, medication, and personal essentials where advised, following guide instructions at all times, disclosing relevant medical conditions honestly, behaving respectfully toward guides, guests, wildlife, and the environment. Peak Perspectives reserves the right to refuse participation without refund where a participant: appears intoxicated, behaves dangerously or aggressively, lacks suitable equipment or attire, presents an unreasonable safety risk, or is physically unable to safely complete the activity.

7. Medical Conditions & Fitness

Participants acknowledge that hiking and outdoor activities can be physically demanding. Participants must disclose all relevant medical conditions, injuries, allergies, physical limitations, or other concerns that may impact participation. Participants certify that they are physically capable of participating in the booked activity. Participation during pregnancy is undertaken entirely at the participant’s own risk and only with prior disclosure and appropriate medical clearance where necessary. Peak Perspectives reserves the right to decline participation where safety concerns arise.

8. Minors 

Participants under the age of 18 must be accompanied by a parent or legal guardian unless otherwise agreed in writing. The minimum recommended participation age is 7 years old, depending on the activity. Parents or guardians accept full responsibility for minors participating in any activity.

9. Inherent Risk & Rescue Delays

Participants acknowledge that hiking and outdoor activities involve inherent risks including but not limited to: slips, falls, rockfall, exposure, dehydration, heat illness, changing weather, wildlife encounters, uneven terrain, navigation hazards, and delayed access to emergency assistance. Participants acknowledge that mountain rescue or evacuation services may be delayed, unavailable, weather-dependent, or limited by terrain and environmental conditions. Participation is undertaken voluntarily and entirely at the participant’s own risk.

10. Emergency Treatment & Evacuation 

In the event of injury, illness, or emergency, participants authorize Peak Perspectives to seek or arrange emergency medical treatment or evacuation where reasonably necessary. Participants remain fully responsible for all associated medical, rescue, evacuation, transport, and related costs. Peak Perspectives strongly recommends that all participants maintain appropriate medical aid, travel insurance, and emergency evacuation cover where applicable.

11. Photography, Media & Content Usage 

Peak Perspectives may capture photographs, videos, or other media during activities for promotional, editorial, archival, or social media purposes. By participating, participants grant Peak Perspectives permission to use such content unless written notice requesting exclusion is provided prior to the activity. Participants may repost or share media for personal, non-commercial purposes with appropriate credit. All media captured or created by Peak Perspectives remains the intellectual property of Peak Perspectives unless otherwise agreed in writing. Commercial use, reproduction, resale, editing, or redistribution of Peak Perspectives content without written permission is prohibited.

12. Environmental Responsibility 

Peak Perspectives encourages respectful interaction with natural environments. Participants agree to: avoid littering, remain on designated trails where applicable, respect wildlife and vegetation, avoid damaging natural features, and follow Leave No Trace principles wherever reasonably possible.

13. Drones 

The use of drones during Peak Perspectives activities is prohibited unless expressly authorized in writing.

14. Transport Assistance 

Peak Perspectives may, at its discretion, assist participants in arranging or facilitating transport to and from activity locations. Such assistance does not constitute a formal transport service unless explicitly stated otherwise in writing. Any transport assistance provided is incidental to the guided experience. Participants acknowledge that transport arrangements may involve third-party providers or informal coordination.

15. Force Majeure 

Peak Perspectives shall not be held liable for cancellations, delays, modifications, or inability to perform services resulting from circumstances beyond reasonable control, including but not limited to: severe weather, wildfire, natural disaster, government restrictions, civil unrest, strikes, accidents, illness, or trail closures.

16. Limitation of Liability 

To the fullest extent permitted under South African law, Peak Perspectives, its guides, employees, contractors, and affiliates shall not be held liable for: personal injury, illness, death, property damage, theft, delays, cancellations, or losses arising from participation in any activity, except in cases of gross negligence or willful misconduct.

17. Governing Law 

These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from participation in activities or services provided by Peak Perspectives shall be subject to the jurisdiction of South African courts.
